Claim Sharks, Consulting Fees & the Real Story Behind VA Claims Support

Reading time: 6 minute(s) read

A flyer is circulating in some veteran communities. Bold design. Stark warnings. The words “Don’t Feed the Sharks” printed over an image of shark fins. Below it, a list of companies — including veteran consulting organizations — branded as predatory. The implication is clear: if a company charges for VA claims assistance, it is exploiting veterans.

We’re going to address this directly, because veterans deserve a straight answer rather than a one-sided argument. Some of what that flyer says is legitimate. A lot of it isn’t. And the things it leaves out are arguably more important than the things it includes.

Why the VA System Created a Market for Private Help

Nobody starts a business helping veterans navigate VA claims because the process is simple. The VA disability claims ecosystem expanded dramatically following post-9/11 conflicts, and the system strained under the weight of that growth. At its peak backlog in 2013, the VA had over 600,000 pending claims. Processing delays stretched months, sometimes years. Veterans with legitimate claims — service-connected conditions that clearly qualified for compensation — were waiting in a queue managed by an overworked bureaucracy.

VSOs — Veterans Service Organizations — absorbed as much of that overflow as they could. They do essential, often underappreciated work, and they do it for free. But they are not infinitely staffed. A VSO counselor managing hundreds of active cases cannot provide the same level of individual attention as a private consultant handling a fraction of that load. Some veterans wait weeks or months for a scheduled appointment. Some end up with underprepared claims that come back denied. Good veterans with legitimate claims fall through the cracks.

Private consulting services exist because of that gap. Not to exploit veterans — to serve them when the existing infrastructure doesn’t have the capacity to.

What Private VA Consulting Is — and What It Isn’t

The claim shark narrative conflates two legally and functionally distinct things: VA representation and VA consulting. The distinction matters.

VA-accredited attorneys and claims agents are authorized to formally represent veterans before the VA. They can act on a veteran’s behalf in legal proceedings, file paperwork in the veteran’s name, and argue cases before the Board of Veterans’ Appeals. Their services are regulated, and so is what they can charge.

VA consulting — the category that Vital Veterans operates in — is different. We provide education, strategy, documentation guidance, and structured support. We help veterans understand their eligibility, build stronger claims, organize their evidence, and navigate a process that is genuinely complex. We do not represent veterans before the VA in a formal legal capacity. We help them arrive at that process better prepared.

The analogy that holds up: this is no different from a tax preparer versus a tax attorney. One helps you organize your return and navigate the process. The other represents you if things become adversarial. Both are legitimate. Both are legal. Both are widely used and accepted in every other context outside veterans benefits.

The Fee Comparison That Deserves to Be Made

If the concern about claim sharks is fundamentally about money — about who is charging what for access to veterans’ benefits — then let’s have that conversation completely.

VA-accredited attorneys are legally permitted to charge between 20 and 33 percent of a veteran’s retroactive back pay award. On a case where a veteran receives $50,000 in back pay after a multi-year appeals process, that’s $10,000 to $16,500 in fees. That money comes directly from the lump sum the veteran waited years to receive. That model is legal, regulated, and essentially unquestioned in public discourse about who is taking advantage of veterans.

Here is how Vital Veterans structures our fees: we charge four times the veteran’s monthly benefit increase. If we help a veteran increase their monthly benefit from $700 to $1,200 — a $500 per month improvement — our fee is $2,000. It can be paid monthly or over five months. If there is no benefit increase, there is no charge. We do not touch back pay. We do not take a percentage of lifetime benefits. We do not create ongoing financial obligations beyond the service period.

We are not suggesting that accredited attorneys are overcharging or acting in bad faith — they provide an important service and their fees reflect the legal complexity of the work. We are saying that when the conversation about who is exploiting veterans focuses exclusively on private consultants while ignoring this comparison, it is an incomplete conversation.

On Bad Actors — and Why Genuine Transparency Fixes the Problem

Are there bad actors in private VA consulting? Yes. There are bad actors in every industry — in healthcare, finance, law, real estate, and in veteran services organizations themselves. The existence of bad actors in a category is not an argument for eliminating the category. It’s an argument for better standards, clearer disclosure requirements, and more enforcement against those who violate them.

What genuine protection for veterans looks like: mandatory written disclosure of all fees before any agreement is signed. Clear written distinction between consulting and legal representation. Prohibition on guaranteed rating claims — which no legitimate organization makes. Transparency about what is and isn’t included in the service. That framework protects veterans without restricting their choices or eliminating legitimate services that serve a real need.

Vital Veterans has never promised a specific rating to any veteran. What we promise is a process — organized documentation, strategic claim structure, and support through a system that is genuinely difficult to navigate alone. Our results come from that process, and those results are documented in the veterans we serve.

The Bigger Problem Nobody Is Addressing

Here’s the question that deserves to be at the center of this entire debate: why are we investing so much energy in restricting who helps veterans navigate the system, rather than improving the system itself?

A significant percentage of veterans are not rated at 100% disability despite having conditions that qualify. Many receive no dental care through the VA because they don’t meet the rating threshold for dental eligibility — even though dental health is directly linked to cardiovascular disease and systemic infection. The appeals backlog has shrunk from its 2013 peak but remains substantial. Veterans who filed claims for conditions connected to toxic exposure are still navigating a system that wasn’t built to accommodate them quickly.

The claim sharks conversation draws attention to who profits from helping veterans. That’s a reasonable conversation to have. But it’s a distraction from the more important conversation about why veterans need so much outside help in the first place. The answer to that question is a VA system that is underfunded, understaffed, and under constant strain. Fixing that problem — rather than restricting the private market that fills the gap — would actually protect veterans.

What Vital Veterans Stands For

We’re a veteran-founded organization based in Jacksonville, Florida. Most of our team has lived the VA claims process personally. We know what it feels like to get a denial. We know what it costs to wait. We know how confusing the system is when you’re navigating it without support. That’s why we built this.

We charge a fair fee. We disclose it completely. We don’t charge if we don’t deliver results. And we believe veterans deserve every option available to them — including the option to work with us.
